Divorce Over Failure to Provide Maintenance in UAE
According to Article 77 of the UAE Personal Status Law, if the husband fails to support his wife or if collecting maintenance from him is impossible, the court will give him up to 30 days.
If he still refuses to pay without a valid excuse, the court will grant a divorce.
If the husband claims financial incapacity and proves it, the judge will allow up to 90 days for payment to be made.
If he does not pay within this period, the judge will impose a divorce. This will be a minor, irrevocable divorce.
If the wife files for non-support more than twice, and the court finds no support each time, the judge will grant her an irrevocable divorce upon her request.
